Drug Recalls by the Federal Drug Administration (FDA)

With respect to pharmaceutical injuries the Federal Drug Administration (FDA) divides its drug recalls into three classes:

• Class l Recalls are for products which could cause serious injury or death.
• Class ll Recalls are for products which might cause serious injury or death.
• Class lll Recalls are for products which are unlikely to cause injury or illness, but nonetheless do violate FDA Regulations.

Remember the product doesn’t have to be the sole cause of the injury or illness.  Depending upon the degree of danger – and its history of causing harm or death – if the product contributes to the cause of harm, you may have a very strong Product Liability Case.
